Statutory Maternity Pay explained

What you get, who qualifies and what to do if you do not.

How much you get

Statutory Maternity Pay is paid for up to 39 weeks. For the first six weeks you get 90% of your average weekly earnings before tax. For the next 33 weeks you get £194.32 a week or 90% of your average weekly earnings, whichever is lower. Tax and National Insurance are deducted as normal.

Who qualifies

You must earn on average at least £129 a week and have worked for your employer continuously for at least 26 weeks continuing into the qualifying week, which is the 15th week before the week the baby is due. You also need to give your employer the correct notice and proof of pregnancy.

A worked example

With average earnings of £540 a week, the first six weeks pay £486 a week, and the next 33 weeks pay £194.32 a week, because that is lower than 90% of £540. The total over 39 weeks is £9,328.56 before tax.

If you do not qualify

You may be able to get Maternity Allowance instead, which is claimed through Jobcentre Plus. Many employers also offer enhanced maternity pay under the contract, so check your employment terms.
